There’s been a lot of media coverage (and even more speculation) about recent federal legislation and what it means for hemp and CBD products. Read on for more detailed insight into what this legislation means for CBDistillery and your favorite products, but the bottom line is: While CBDistillery is not going anywhere, this bill would greatly limit the type of products available to support your wellness goals.
What happened?
Last week, Congress approved an appropriations bill to end the government shutdown. Traditionally, substantive changes to law such as this are outside the scope of an appropriations bill, but Senator Mitch McConnell included severe regulations for hemp and CBD products. While this law isn’t set to take effect until November of 2026, when it does go into effect, the vast majority of hemp wellness products will be considered federally illegal. Though Sen. McConnell has claimed this language is meant to ban or significantly restrict intoxicating hemp products, – it goes far further than that rationale, and will negatively affect hemp companies trying to provide safe, quality CBD products (like us) and the customers who rely on them to support their wellness (like you).
Simply put, this bill constructively bans the sale of any product containing THC of any sort, by restricting total THC to 0.4mg per container of CBD products. This is less than what is traditionally seen in a single serving of our Full Spectrum hemp CBD products. In addition, many products containing minor non-intoxicating cannabinoids such as CBN, CBG, CBDV, CBC and THCV could be affected.
What does this mean for CBDistillery and my favorite products?
For the moment, nothing, as these regulations will not take effect until November of 2026. During that time, our company and others will work with elected officials, some of which have publicly stated their support for revisiting these regulations, to develop a working regulatory framework that will clean up the market, while allowing consumers continued access to therapeutic non-intoxicating cannabinoids.
Whether or not the THC limit is adjusted, CBDistillery is not going anywhere. Our Broad Spectrum CBD and Isolate products are not affected by this new legislation, and we are already working on plans for innovating these products lines in the event that the legislation does not change.
What happens next?
In the meantime, we will be working diligently to help lawmakers better understand the hemp/CBD industry and to support regulations that improve the hemp industry without restricting your access to Full Spectrum hemp products. We support regulations requiring third-party testing, restricting synthetic intoxicating cannabinoids and enacting age requirements – all things that we have chosen to do since the beginning, because we think it’s important to create high-quality products that you can trust. But while we have chosen to take those steps, not all hemp companies have (if you’ve ever seen products at a gas station with suspiciously high levels of Delta-8 or Delta-10 THC and packaging that strongly resembles popular candy brands, you know what we’re talking about).
We don’t believe the recently-passed regulations are the answer, but we do believe that the right regulations can create a safer, more transparent CBD industry. The situation is likely to change before these new regulations take effect in November of 2026, and we will keep you updated as it does.
